1. Contractual Relationship

These Terms of Use (“Terms”) govern the contractual relationship between Buuk Ride Technology LTD (“Buuk Ride,” “we,” “us,” or “our”) and you (“User,” “Individual”), within Nigeria. These Terms apply to your access and use of our mobile application, website, and any related services (collectively, the “Services”).

By creating an account, accessing, or using Buuk Ride, you confirm that you have read, understood, and agree to these Terms, thereby forming a legally binding agreement between you and Buuk Ride. If you do not agree, you are not permitted to use the Services.

Buuk Ride operates solely as a technology platform that connects riders with independent third-party transportation providers (“Drivers”). We do not provide transportation services and are not responsible for the actions or conduct of drivers.

2. Modifications & Termination

2.1 Modification of Terms

Buuk Ride reserves the right to modify these Terms at any time. Updated Terms will be posted on our website or mobile application. Continued use of the Services after changes have been made constitutes acceptance of the revised Terms.

2.2 Termination of Agreement

This contract remains in effect until terminated by either party. Buuk Ride may suspend or terminate your account if:

  • You violate these Terms.
  • You engage in fraudulent, abusive, or illegal activities.
  • You disrupt or misuse the Services.
  • You fail to pay outstanding balances.
  • Multiple complaints are lodged against you.
  • You fail to comply with road safety regulations, including:
    a. No driving under the influence of drugs or alcohol.
    b. Mandatory use of helmets for motorcycles.
    c. Compliance with all traffic laws and speed limits.

Drivers' Right to Terminate: Drivers may terminate their service agreements based on Buuk Ride’s policies.

3. Services & User Conduct

3.1 Nature of Services

Buuk Ride is a technology platform that enables users to arrange and schedule transportation and logistics services with independent third-party providers.

  • The Services are for personal use only and not for business purposes (e.g., reselling rides, unauthorized commercial activities).
  • Buuk Ride does not own, operate, or control transportation services.

3.2 User Conduct & Restrictions

By using Buuk Ride, you agree not to:

  • Misuse the Services or engage in any illegal or harmful activities.
  • Disrupt or interfere with the platform’s functionality.
  • Fraudulently alter ride fares or engage in fare manipulation.
  • Create multiple or fake accounts.
  • Use another person’s account without authorization.

3.3 Safety & Background Checks

  • Drivers must undergo background checks and safety training before approval.
  • Buuk Ride may deny or revoke driver access based on background check results.

4. Payment & Pricing

4.1 Charges & Payment

  • Charges for rides and services are determined by Buuk Ride.
  • Payments are processed via approved digital payment methods.
  • Charges include applicable fees such as booking fees, tolls, and surcharges.

4.2 Refunds & Cancellations

  • Payments made are non-refundable, except as determined by Buuk Ride.
  • A cancellation fee may apply if a ride is canceled after booking.

4.3 Pricing Commitment & Restrictions

Drivers must honor the agreed fare before starting a trip and are prohibited from:

  • Increasing or modifying the fare after acceptance.
  • Canceling rides excessively to manipulate pricing.
  • Demanding additional payments beyond the agreed fare.

Violations may result in:

  • First-time offense: Warning or temporary suspension.
  • Repeated offenses: Extended suspension or deactivation.
  • Severe violations: Permanent account deactivation.

5. Liability & Indemnification

5.1 Disclaimer of Liability

Buuk Ride does not guarantee:

  • The reliability, safety, or performance of third-party service providers.
  • Uninterrupted, error-free service.
  • The quality or competence of drivers.

By using the platform, you assume all risks associated with your ride.

5.2 Limitation of Liability

To the maximum extent permitted by law, Buuk Ride is not liable for:

  • Indirect, incidental, punitive, or consequential damages.
  • Any loss of property, personal injury, or accidents during rides.
  • Any issues arising between users and third-party drivers.

Buuk Ride’s total liability for all claims is capped at ₦200,000 or the total service fees paid within the past six months, whichever is lower.

5.3 Indemnification

You agree to defend, indemnify, and hold harmless Buuk Ride from claims, damages, and legal fees arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Any claims related to your interactions with drivers or other users.

6. Lost Property Policy

Buuk Ride is not responsible for items left in vehicles. If an item is found:

  • The driver may return it to the owner directly.
  • If handed to Buuk Ride, the owner must claim it within three months.
  • Unclaimed items may be donated or discarded.

7. Governing Law & Dispute Resolution

  • These Terms are governed by Nigerian law.
  • Disputes shall first be resolved through mediation under the Nigerian Arbitration and Mediation Act 2023.
  • If unresolved, disputes will be settled in a competent Nigerian court.

8. Intellectual Property & Copyright Protection

  • Buuk Ride’s trademarks, logos, and proprietary technology are legally protected.
  • Unauthorized copying, imitation, or fraudulent use of Buuk Ride’s brand is strictly prohibited.
  • Buuk Ride reserves the right to take legal action against violations.

9. Firearms & Weapons Policy

  • Firearms, knives, explosives, and any dangerous weapons are strictly prohibited while using Buuk Ride.
  • Violators may face immediate account suspension or legal action.

10. Reporting Violations & Enforcement

Users can report violations via:

  • The Help Center in the app.
  • Contacting Buuk Ride Support.

Enforcement actions include:

  • Warnings or temporary suspensions.
  • Permanent account deactivation for severe violations.

Buuk Ride is committed to safety, fairness, and transparency for all users. By using our platform, you agree to abide by these Terms. Failure to comply may result in loss of access to our services.
